Power and Politics in Organizations Essay

Abstract In organizations there are various force-outs, conflicts and political intrigues at play. Some of these powerfulnesss whitethorn not appear not amount to something much to the untrained eye but those privy to these power struggles know that they go a long way in shaping the destiny and the future of an organizations. When there is a change of leadership in an organization e. g. in cases where the C. E.O is retiring or abject elsewhere, the successor allow want to impose his business philosophy on the organization. He does this by wielding his lawful authority (that of being C. E. O or the boss). He or she whitethorn do this by honor those employees who embrace his or her business style and coerce those whom they feel are stubborn to their authority. Coercion will oftentimes involve threats of firing or demotion or promotion stifling against errant employees. Employees who are depended upon for the keep company to run smoothly (i. . those who own expert power) may surv ive the onslaught because the executive officer may not want to jeopardize company operations. This however, may be temporary if the executive officer looks for qualified replacements for the errant expert employees and then forces the incumbent out of the company or into positions less glamourous. In this assignment, I take a shit looked into a case involving a blue chip company in East Africa called Safaricom Ltd and the power struggles between the incumbent C. E. O and top level expert employees.Safaricom says the two resigned but they might have been the first victims of the new C. E. Os no nonsense approach to business. Before his resignation, Mr. John Barorot had been Safaricoms Chief Technical Officer. He was one of the longest serving employees having joined the company in 2000. The opposite person who seems to have received the sack was the Chief Information Officer Mr. Robert Mugo. The power and political intrigues inwardly the company saw the exit of the two with anal ysts indicating that Mr.Collymore viewed them as a challenge to his authority in the company. He used his licit power to get the two to resign. Mr. Barorot opted to resign rather than go through a new rigorous talent assessment procedure. This indicates the presence of coercive powers in the company. Despite their expertise in their various capacities, Mr. Barorot and Mr. Mugo could not rely only on their expert power to retain their jobs. Hence, they were trounced by the legitimate power wielded by the Chief Executive Officer.

Tort Walk

delinquent and Intentional Tort Barry University EDU 674 The Legal Environment in Education Timothy D. Blevins, J. D. While conducting a civil wrong walk at oneness of the local middle instills we identified several possible torts. One was of a building code violation, an separate in the way money was handled in the lunch room. I am going to pursue the building code violation and what the possible injury could be if not corrected. Upon our tort walk we discovered several windows open to the vernacular areas. These windows were out far enough for a psyche to walk or run in to. Depending on the persons size this could very easily flummox severe injury to oneself. The windows are approximately four feet off the ground tilted out into the courtyard where students and dexterity move about. When the bell sounds to change classes there is a lot of movement and confusion. It is easily seen to an observer how one could get hurt. Florida Statute 1001. 2 Says Maintenance and upkeep of s chool plant will provide adequately for the proper maintenance and upkeep of school plants, so that students may attend school without sanitary or physical hazards, and provide for the necessary heat, lights, water, power, and other supplies and utilities necessary for the operation of the schools. Second, make or contract for additions, alterations, and repairs on buildings and other school properties. Ensure that all plans and specifications for buildings provide adequately for the safety and swell-being of students, as well as for economy of construction.Florida Statute 1001. 43 authorizes facilities worry thru the rule school board to adopt policies providing for management of the physical campus and its environs, including, but not limited to, energy conservation measures building and ground maintenance fencing, landscaping,( and other property improvements) site acquisition (new construction and renovation) dedication and rededication or naming and renaming of di nonindulgen t buildings and other district facilities and development of facilities management planning and priorities. stiff obligation by the law essentially means liability that is imposed on an actor apart from all, intent to interfere with a legally protected evoke without legal justification for doing so, or a breach of a duty to exercise reasonable care. Strict liability arises as a result of the abnormal danger of the activity itself and the endangerment that it creates to those in its neck of the woods (Alexander, 2009).Whether an activity is ultra hazardous or abnormally wild requires asking whether the risk created is so unusual, either because of its magnitude or because of the magnitude or because of the circumstances surrounding it, as to justify the imposition of strict liability for the disablement that results from it, even though it is carried out with reasonable care. There are six factors for determine whether an activity is abnormally dangerous Existence of a high de gree of risk of some harm to the person, land or chattels of others Likelihood that the harm that results from it will be great Inability to eliminate the risk by the exercise of reasonable care Extent to which the activity is not a matter of common usage Inappropriateness of the activity to the place where it is carried on Extent to which its value to the community is outweighed by its dangerous attributes. All of these factors are important in consideration, but not all are required, and one is not more important than the other. Negligence can be a part of this scenario as well. Negligence differs from an intended tort in that negligent acts are neither expected nor intended, whereas an intentional tort can be both expect and intended. With negligence reasonable person in the position of the actor could have anticipated the harmful results. An example of this is the window open at the school during class change. The school knows the courtyard is displace at this time and have been notified previously that it is a danger to students and faculty. A student runs into it not gainful attention while talking to another student. Johnnys eye is severely cut and requires operation to fix it. This scenario would follow under this term negligence. It was not really intentional nor was it anticipated but it did happen. The school would be liable in this case. Reasonable person has been described by different courts but has slightly four elements The physical attributes of the personNormal intelligence Normal perception and memory with a lower limit level of information and experience common to the community Such superior skill and knowledge as the actor has or holds himself or herself out to the habitual as having. To have a valid cause of negligence, certain prerequisites must exist. These four categories are divided like this A duty to protect others A failure to exercise an appropriate standard of care The existence of a casual connection amongst the act and inj ury, called proximate or legal cause An injury, damage or lossBuilding codes for public schools are different than private schools. Under the building codes for Florida schools certain safety regulations are required to be in place. Older schools have to be refitted to the standards of today. Some schools are condemned and others remolded to remain open. My course of action would be to retrofit the school with windows that do not open to the outside courtyard that could possibly injure personnel, or to secure the windows so they can only open an inch to prevent students from coming in impinging with. Better to fix the problem now before there is a law suit.

Should the 'crimes' of the 'law-abiding majority' be criminalised more Essay

Should the offences of the law-abiding majority be criminalised more frequently - Essay ExampleThis means that the legal locating of a doings whether defined as a crime or not is in not in the content of the behavior itself, but lies in the social response to the behavior in school principal and the changes in the legal status of the behavior can be brought about by the transitions in the society. It should similarly be noted that the social response to crime including numerous explanations for crime argon based not only on the nature of the act itself but also on the moral and social stand of the offender as related to that of the victim. Further, it is noted that in the absence of every ontological reality of crime, in that location atomic number 18 tests that are used in the construction of crime, one of which is the test of intention to blame the crime cognise as Mens rea (Hillyard 2005a, p.9). There is an area of criminal activity that occurs in the current society that take crimes and unfair practices that are committed in the society and are usually committed by nation who see themselves as law abiding and who would readily reject the label of being criminals (Karstedt & Farrall 2007, p.7). They are known as the law-abiding majority but they fail to understand that just about people do not choose to abide by the law but are forced to abide by its render or are selective in their compliance with the law. It is important to note from the onset that though the behavior under discussion may be unscrupulous or unfair, it appears normal in the eyes of most offenders who try to justify it. The offences by the law abiding majority are that the middle class commit the offences or ill practices but are also eager to blame the perpetrators when they find out that they are the victims of such behavior. Research has shown that the law-abiding majority may bend more rules than what is in the public state (Karstedt and Farrall 2006, p.1039). The crimes by the law abiding citizens though may be crimes of everyday life, they may not be regarded as antisocial per se but could be termed as anti-civil as they show the absence of politeness among the citizens who should show the opposite character (Green, Grove and Martin 2005, p. 233). Not all behaviors are usually considered as ill-gotten in general but some are deemed morally dubious by both victims and the offenders and are not unusual or outstanding in nature but are mundane. Whether s.5 Public station Act 1986 offences is more likely to be prosecuted than Health and Safety offences committed in the workplace percentage 5 of the United Kingdom the Public Order Act 1986 was expounded in the recent case of Harvey v DPP 2011 All ER (D) 143 which gave the threshold of the offences under this provision. The case gave what should be used in the determination of the occurrence whether words used are abusive as interpreted against scratch 5 of the act and when certainty of their impact on an individual can be required by the court (Brown & Ellis 1994, pp.1-4). Under section 5 of the Public Order Act 1986, an offence can only be deemed so if it possesses twain elements and include the fact that a person must have made use of intimidating, insulting or offensive words or behavior. Arbitration Assignment Example | Topics and Well Written Essays - 250 words

Arbitration - naming Examplethers are non bound by the arbitration retainment because they did not directly agree to it, as well as the fact that they were never specifically predicateed of it by HBW. Even though in NCR Corporation vs. Korala Associates Ltd. the court affirmed that arbitration is a legally binding method to result disputes, Baker did not agree to the clause. Osborne Corp did, but only after the original contract had been signed, causing HBW to re-issue booklets to the homeowners that informed them of the agreement. Yet, in doing so, HBW did not call attention to the agreement, which means that the homeowners would have had no notice of it.The morals of this practice can be called into question because while HBW issued booklets to Baker et al with the clause of arbitration included, it did not call any attention to such a agreement nor inform any of the homeowners outright that they would be bound to the agreement. It is not the fault of the homeowners that Osbo rne entered into the agreement, and therefore they do not have to abide by it. The homeowners did not sign the forms with HBW, Osborne did, and without informing the homeowners directly that they had done so, the homeowners cannot be held accountable. It can be inferred that the provision of arbitration was cabalistic in the fine print, and therefore it would be unethical to subject the homeowners to arbitration when they clearly had no way of knowing that they would have to abide by this.It can also be said that both HBW and Osborne failed in their ethical duty to the homeowners, Osborne because they did not inform the homeowners that they (Osborne Corp.) had entered into the arbitration agreement with HBW, and HBW because it did not clearly inform the homeowners that they were required to solve disputes by arbitration rather than by filing suit.Baker and the other homeowners, flat though there is an agreement for arbitration under the warranty, are not bound by it because they d id not sign the agreement directly
